Terms and Conditions

Guidelines

These Terms and Conditions between you and Savage Software Group Pty Ltd ABN 43 129 265 434 are legally binding. Instructions on how to enter and details regarding prizes form part of these Terms and Conditions. By participating in the Procreate Art Prize, you accept these Terms and Conditions. 

You warrant that the entry which you submit is entirely your own; you may not submit an artwork incorporating external or third party content. 

One entry per person. You must have a Procreate account to enter.

Anyone over the age of 13 can enter the Procreate Art Prize, provided the artwork submitted:

a) has been created entirely in Procreate for iPad and/or Procreate Pocket for iPhone; 

b) meets the competition brief of “Contrast”; and

c) meets the requirements outlined in these Terms and Conditions. 


The promotional period begins at 12:01 am (AEST) on October 3, 2019 and finishes at 5:00 pm (AEDT) on November 15, 2019. The judging panel, appointed by Savage, will determine the two prize winners and any runners up. The winning Entrants will be informed by email and must respond to claim their prizes.

To enter, submit your original artwork through the Procreate Art Prize Competition page. Personal information provided by Entrants will only be used for the purposes outlined in these Terms and Conditions and will be handled in accordance with the Savage Software Privacy Policy

Any questions, comments or complaints about this promotion must be directed to Savage.

Limitation & Responsibility

The artwork must not be, without limitation:

a) late;  


b) unlawful;  


c) obscene; 


d) defamatory; 

e) discriminatory; 


f) threatening; 


g) pornographic; 


h) harassing;  


i) hateful;  


j) racially or ethnically offensive;  


k) capable of encouraging criminal conduct; 


l) capable of giving rise to civil liability.


Savage will use reasonable care in handling submitted artworks. Subject to the above, no responsibility will be taken by Savage for loss of or damage to artworks in editing, or during the process of submission.

Entries

Entries will be judged on creativity, originality, and merit and based on the competition brief. The judges' decision in relation to any aspect of the Competition will be final and binding on every person who enters. No correspondence will be entered into.

Submissions must be an original artwork by the Entrant which does not infringe the rights of any third party. The Entrant agrees to indemnify Savage against all claims and costs by third parties arising from a breach of the above warranty.

Submissions must be created in Procreate and/or Procreate Pocket. Submitted work must have time-lapse enabled on the artwork file. Judges may request a copy of the original file to check the validity of the entry. Entries without time lapse enabled cannot win a prize.

Artwork canvas must have a minimum size of: Width 2000px, Height 2000px. However, the canvas is not restricted to a 1:1 ratio.

Entries must be submitted before November 15th, 5:00pm AEDT.

Submissions remain the property of the Entrant, and the Entrant retains all copyright and other intellectual property in the submitted artwork but agrees to waive their moral rights (as that term is defined in the Copyright Act) 1968. By submitting, the Entrant licenses Savage on a perpetual and irrevocable basis to use their artwork in digital and printed promotional material.

Savage reserves the right to disqualify any Entrant who submits an entry that breaches these Terms and Conditions or in some other way fails to comply with the entry process.

The best two artworks received from Entrants, as determined by the judges, will be deemed the prize winners and will win the prizes outlined in these Terms and Conditions below. Submissions which do not win a prize may still receive honourable mentions at the discretion of the judges.

Prizes

The following prizes will be awarded by the judges:

Grand Prize: $5,000 USD
Second Prize: $2,000 USD

Once officially notified, winners must provide valid bank account details for the transfer of prize money. Savage Software Group will transfer prize money to winners within 30 days of receipt of the valid bank details of the winner.

For winners under the age of 18, prizes will be awarded to the winner’s parent or legal guardian on their behalf. Savage accepts no responsibility in the event that a person incorrectly represents themselves to be a winner’s parent and/or legal guardian and misappropriates a prize. It is the responsibility of individuals and, where relevant, their parent/s and/or legal guardian/s, to ensure Savage has been provided with correct details. 

Savage accepts no liability for any late, lost or misdirected mail.

General

Savage reserves the right to cancel, terminate, modify or suspend the promotion, subject to all relevant state and territory rules and regulations, at any time.

Savage will not be liable for any loss arising from unforeseen circumstances, such as the effects of war, terrorism, state of emergency or disaster (including but not limited to a natural disaster),

If it becomes impossible, impractical or inappropriate for any reason to conduct this promotion as reasonably anticipated, Savage reserves the right to address the issue by: 

a) to disqualify any Entrant; or  


b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion. 


If health or medical issues restrict your ability to enter the Competition, you may still be eligible to enter - please contact Savage's support team for further assistance. We may request you sign legal documentation to verify medical circumstances, and it is a condition of accepting the prize the winner sign any such legal documentation.  Medical information will be handled securely and in accordance with our statutory responsibilities.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Savage (including its respective officers, employees and agents) excludes all liability for any loss or damage, whether direct, indirect, special or consequential, arising in any way out of the promotion, including loss or damage involving or resulting from or resulting in:

a) negligence;

b) personal injury;

c) disqualification of any Entrant;

d) or any technical difficulties or equipment malfunction (whether or not under Savage’s control);

e) any theft, unauthorized access or third party interference; 

f) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Savage) due to any reason beyond the reasonable control of Savage; 

g) any variation in prize value to that stated in these Terms and Conditions;  

h) any tax liability incurred by a winner or Entrant; or

i) use of a prize.

You should, however, at all times remain aware that you may have various rights under the Australian Consumer Law or the Privacy Act 1988, and advice should be sought where it is thought necessary.
